Safety management for Machinery, Equipment and Tools

To ensure the safety of workers in the workplace, the Occupational Safety and Health Act (the Act) was amended and promulgated on July 3, 2013. The Order of Executive Yuan required that the Management System for the traceability of machinery, equipment and tools for workers specified in Article 7 to Article 9 of the Act shall be enforced from January 1, 2015. The machinery, equipment, or tools specified by the MOL include power punching-shearing machinery, hand-push planer, circular saw for woodworking, power fork lift truck, grinder, lapping wheel, explosion-proof electrical apparatus, photoelectric safety device for power punching-shearing machinery, blade guard for hand-push planer, kickback prevention device and the saw teeth touching protective devices for woodworking circular saw. The manufacturers or importers of these machinery, equipment, or tools shall ensure the conformity with the specified safety standards or require to pass the type certification performed by a certification body authorized by the MOL in accordance with the Act. They shall be registered by manufacturers or importers on the information reporting website specified by the MOL. Manufacturers or importers shall put up the TS Safety Label or Certification Mark in a prominent place on the manufactured or imported products for identification.

Since July 2018, Type Certification of Machinery, Equipment and Tool has been introduced and emphasized. Voltage reducing devices for AC arc welding equipment shall not be manufactured and shipped from the factory nor imported by manufactures or importers if their Certification Marks and certificate of conformity for type certification are not issued by a certification body authorized by MOL.

Respectively, in August 2019 and January 2023 this has been applied to traditional (ie. Non- numerically controlled) and numerically controlled lathes and milling/boring machines, as well as machining centers and machining systems, requiring manufacturers or importers to register devices that conform to safety standards on the Information Reporting Website and to attach TS Safety Labels to the machinery, equipment, or tools.

Manufactures, importers, suppliers or employers could find the information of the registered machinery, equipment and tools for workers on the information reporting website (the web site is https://tsmark.osha.gov.tw). The machinery, equipment, or tools specified by the MOL whose structures, functions, or safeguards do not fulfill safety standards shall not be manufactured and shipped from the factory, nor imported, rented out, supplied or installed by manufactures, importers, suppliers or employers.
